If you don't agree with any part of these Terms, please don't use our website or purchase our products.

1. About Primal Baseline

Primal Baseline ("we," "us," "our") is a wellness brand based in Massachusetts that designs and sells grounding products, including the Primal Grounding Sheet. Our business is registered in the Commonwealth of Massachusetts.

You're responsible for maintaining the confidentiality of your login credentials
You're responsible for all activity under your account
You must notify us immediately at info@primalbaseline.com of any unauthorized account access
We're not liable for losses resulting from unauthorized account use if you fail to safeguard your credentials

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse our policies.

4. Product Information & Availability

We do our best to display our products accurately, including colors, materials, dimensions, and descriptions. However:

Slight variations may occur due to monitor settings, lighting, or natural material differences
Product specifications may be updated as we improve our designs
All products are subject to availability — we reserve the right to limit quantities or discontinue products at any time
Pricing is subject to change without notice, though changes won't affect orders already placed

In the rare event of a pricing or product description error, we reserve the right to cancel affected orders and issue a full refund.

5. Orders & Payment

Placing an order: When you place an order, you're making an offer to purchase. We reserve the right to accept or decline any order at our discretion.

Order confirmation: You'll receive an order confirmation email within minutes of placing an order. This confirmation does not guarantee acceptance — we may cancel orders due to inventory issues, payment problems, or suspected fraud. If we cancel your order, we'll refund you in full.

Payment:

We accept major credit cards, debit cards, and other payment methods displayed at checkout
Payment is processed at the time of order
All prices are in U.S. dollars unless otherwise noted
You're responsible for any applicable sales taxes (calculated at checkout based on your shipping address)
Massachusetts residents are subject to Massachusetts sales tax where applicable

Pricing errors: If a product is listed at an incorrect price due to a typographical or system error, we reserve the right to refuse or cancel the order, even after order confirmation has been sent. If we cancel due to a pricing error, you'll receive a full refund.

90 nights from delivery for first-time customers (no returns required)
30-day standard return policy for repeat orders
Refunds processed within 5-7 business days of approval

Our products are provided "AS IS" and "AS AVAILABLE." While we stand behind the quality of our products with our 90-Night Sleep Guarantee, we make no warranties beyond what's expressly stated in these Terms and our Return & Refund Policy.

Some jurisdictions don't allow certain limitations on warranties or damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

This limitation of liability does not apply to:

Our gross negligence or intentional misconduct
Bodily injury caused by defective products (where applicable law requires)
Statutory rights that cannot legally be waived

Any disputes arising from these Terms or your use of our products or website will be resolved exclusively in the state or federal courts located in Hampden County, Massachusetts. By using our website or purchasing our products, you consent to the personal jurisdiction of these courts and waive any objection to venue.

This provision does not affect any statutory rights you may have under applicable consumer protection laws, including Massachusetts General Laws Chapter 93A.

20. Dispute Resolution

Before filing any lawsuit, you agree to first contact us at info@primalbaseline.com to attempt to resolve the dispute informally. We'll respond within 10 business days and work in good faith to resolve the issue.

If informal resolution fails after 30 days, either party may pursue legal action in Hampden County, Massachusetts as described in Section 19.

No Class Actions: You agree to resolve disputes with Primal Baseline on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative proceedings.

This class action waiver does not apply where prohibited by law.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and Primal Baseline regarding your use of our website and products. They supersede any prior agreements, communications, or understandings.

23. No Waiver

Our failure to enforce any provision of these Terms doesn't waive our right to enforce that provision later. No waiver of any term will be deemed a continuing waiver unless we agree in writing.

24. Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms to any affiliate, successor, or acquirer of our business without restriction.
